Dear Diablo,
How do you obtain a corpse on a legal way? Does it make any diiference the way you get the body? I only consider one case that should be allowed: if the dead stated before his death that he-she is agreeing with this practise. Let's consider it as a part of someone's last will. In that case, I would consider the death as a lunatic as well.

I agree completely with alainbouhaz..necrophilia is not a legal issue, but a mental and moral issue. I do not think putting someone in jail for performing such a disturbing deed has any purpose. What they really need is intensive phyciatric help.

you dont have to permanently acquire it, only use it for some time. the corpse isnt damaged or reduced in value by having sex with it, so morticians or people working in hospitals should be in the position to get their hands on bodies.

Say your wife dies. Before you bother reporting it or something, you have sex with it.
Say for some reason you have been given access to a body, whether it be a relic that was worn by the person that you need to get or something or whatever, just somehow gaining legal access to the dead body.

Why would having it be legal promote it? It's been legal forever, but have people started underground necrophilia movements? I don't think so. Rubbing feces all over your face is legal, but do people do it? No.
People will actually be more likely to do it if it gets made illegal, because it's "cool."
